The Home Office has announced an ‘interim period’, during which EEA citizens will continue to have the right to work, study or live in the UK – even in the event of a “no deal” Brexit. The interim period takes effect immediately when the UK leaves the EU. This is to allow a smoother transition as the UK develops its new “skills-based” immigration system.
Protecting the rights and status of EU migrants
Before Brexit, EEA nationals living and working in the UK can apply for the “EU Settlement Scheme”. This grants them with either Permanent or Pre-Settled Status.
Temporary Leave to Remain
In the event of ‘no deal’ Brexit, EU migrants can still enter the UK under an alternative scheme (and work for a maximum of three months) before the “skills-based” immigration plan goes live in 2021. EU nationals who wish to stay in the UK for longer will have to apply for “European Temporary Leave to Remain”. This is an immigration status that grants EEA citizens entry to live, work or study for up to 36 months – but not to settle permanently. Applicants will not be allowed to extend or renew this status. It is a temporary alternative that will not lead to any permanent settlement like as Indefinite Leave to Remain.
How to apply for European Temporary Leave to Remain
This status will be available online and will have a fee. To apply, applicants will need to prove their identity and declare if they have any criminal convictions three months before coming to the UK. Once the European Temporary Leave to Remain has expired, applicants must apply for a visa.
