This commonly-used term is also often used wrongly. Although there is not an internationally accepted legal definition, the most commonly understood version of “migrant” is to describe a person who moves from one country to another so they can find work or improve their living conditions. Migrants may leave their original country to find work, to study or to join their family.
Even though most migrants are not fleeing persecution, they are still entitled to the protection of their human rights. Migrants should not be forced to return to their home countries unless there is a legitimate reason, and the authorities in their new country are expected to protect their rights.
Immigrants
An immigrant is a person who has chosen to settle to another country to that in which they were born. Policies are put in place by each country’s authorities to create a legal process for immigrants to seek the right to legal residency and ultimately citizenship. An illegal immigrant, on the other hand, is an immigrant who has not sought that legal status and is undocumented.
Asylum Seeker
An asylum seeker has fled their home country to seek sanctuary in another country. They have this status while they apply for asylum (the right to be recognized as a refugee). If recognised as a refugee, they receive legal protection and other help. The asylum seeker must demonstrate that their fear of persecution in their country is legitimate and justified.
Refugee
A refugee is considered to be someone who has been forced to leave their country to escape persecution, war or natural disaster. They have a right to international protection and material assistance.
