If an asylum seeker doesn’t meet the criteria for refugee status, they are considered for humanitarian protection. This is the UK’s name for the EU law concept of ‘subsidiary protection’. To be given this refugee protection status, applicants must establish that they would face serious harm if they returned to their country of origin. It is not necessary for them to be at risk of serious harm for any specific reason such as race, religion, or politics. An example of when humanitarian protection might be given is if people are fleeing a conflict zone. Their lives may be at risk should they get caught up in the middle of the fighting.

A person with humanitarian protection receives almost the same status as a refugee: five years of limited leave to remain in the United Kingdom, and they can work, study, use the NHS and claim benefits. After this five year period, they can apply for indefinite leave to remain as long as there has not been a significant change in circumstances for them or their home country.
