Many non-EU family members related to EU nationals will have already applied for documents to prove they have the right to reside in the UK, having done so well before Brexit. They would have already been granted an EEA residence card or an EEA permanent residence card. Some EU citizens have also started to get the documents they need to prove their residence in the UK, particularly after the Brexit referendum, and so they would have been issued with either an EEA registration certificate or another document that confirm their permanent residence.

Those documents, however, will not protect their long-term status in the UK. This may seem to be counter-intuitive, especially for those who were issued “permanent” documents and thought they would protect them. Similarly, EEA residence cards may have an expiry date beyond June 2021, but such applicants will still need to apply for the settled status under the EU Settlement Scheme before the deadline of 30th June 2021. Anyone who has not made an application by then, even if they already have one or more EEA documents that appear to be valid, may become an overstayer in the UK and therefore subject to the hostile immigration environment.
