What Does EU Settlement Scheme Pre-Settled Status Mean?

For those applicants who do not have five years of continuous residence in the UK at the point when they apply under the EU Settlement Scheme pre-settled status will usually be granted. Applicants for this status must have started living in the UK before 31st December 2020 (the date will be 12th April 2019 if there is a “no deal” Brexit). It will be possible to apply to change this status to settled status after achieving five years of continuous residence.

If you have not reached five years’ continuous residence prior to 30 December 2020, then you can choose to wait and apply once you have reached five years’ continuous residence. This means that so long as your application is successful, you will get settled status straight away without first having to apply for pre-settled status. You will be allowed to stay in the UK for five years from the date you are given pre-settled status.
