If you currently live outside of the UK and want to apply for a spouse visa, you must meet certain criteria:
- You must both be over 18
- Between you, you need to have a minimum of £18,600 in the bank – either from income, savings or a combination of the two.
If you do not have sufficient money in your bank account, then you may still be eligible if you are in receipt of certain benefits:
- Attendance Allowance
- Carers Allowance
- Disability Living Allowance
- Personal Independence Payment
- Severe Disablement Allowance
You must also:
- Have appropriate accommodation
- Provide TB test results (if applicable).
- Be able to prove you have an adequate level of knowledge of English
- Be able to support yourself and your dependents without public funding
If you apply from outside the UK, the spouse visa is valid for 33 months. It is possible to extend it for 30 more months, to 5 years in total. After this, you will be eligible to apply for Indefinite Leave to Remain as long as you are still married and living in the UK with your spouse.
Applying for a Spouse Visa From Within the UK
To apply for a spouse visa within the UK, you must:
- Be able to financially support your family
- Be in a civil partnership or marriage
- Have a good knowledge of English
- Have at least £18,600 –as income, savings or combined.
- Have been living in a relationship for two years or more
If you do not have enough money in your bank account but receive certain benefits, you may still be eligible.
