Since Britain left the EU, there have been major changes to the UK immigration system. From 1 January 2021, the tier-based system was replaced with a points-based system that changed the immigration rules, particularly when it comes to EU citizens.

The Tier 2 Work Visa was replaced by the new Skilled Worker Visa. This visa requires UK employers to obtain a sponsor licence to employ workers from abroad.

To sponsor a skilled worker, you have to first apply for a Sponsor Licence. Once you have this, you can provide foreign workers with a Certificate of Sponsorship that allows them to prove to the Home Office they are being recruited by a valid sponsor. As long as they meet the requirements, they will be given a visa and can begin working for you.

Am I eligible for a Sponsor Licence?

To qualify for a Sponsor Licence, your company operate and trade lawfully within the UK. You must submit proof of registration with a statutory body to the Home Office.

Some other requirements include:

  • You must not have unspent convictions for certain crimes, including immigration offences
  • You must appoint one or more individuals in your business to manage the sponsorship process.
  • You have to prove that you are able to offer genuine employment in a skilled occupation and you are paying the appropriate salary
  • You must have HR and recruitment systems in place to meet all the sponsor duties
  • You must prove why you need a foreign national for the role
