The ‘No Recourse to Public Funds’ (NRPF) condition prevents overseas nationals from accessing benefits when in the UK, including housing benefit and asylum support.

Claudia Webbe, MP for Leicester East, criticised the Home Office’s use of the NRPF condition, saying that it has driven thousands to destitution during the Covid crisis. According to Home Office figures, the number of overseas nationals that applied for destitution support has increased by more than five times. She said: “The government claims to be ‘protecting public funds’ by preventing migrants from accessing benefits, yet they do not exhibit the same frugality when handing out multi-million pound contracts to private companies or allowing billionaires and corporations to avoid paying tax.  it is crucial that all residents, regardless of immigration status, can afford to stay safe during the pandemic.”

Webbe argued that the government must ensure overseas nationals have access to mainstream benefits “without fear of deportation”. Migrants’ rights organisations backed the position, including the Migrants’ Rights Network (MRN). MRN Projects Coordinator Mahlea Babjak says it perpetuates structural inequality and racism.

Indefinite Leave to Remain (ILR)

Immigration law says that overseas nationals in the UK with limited leave to remain should be prevented from accessing public funds. Anyone without permanent residence or ILR is barred from accessing school meal subsidies, disability allowance and even child support. However, ILR allows access to a host of UK benefits such as housing benefit and healthcare.
