Brexit is getting closer by the day, and as 2018 draws to a close, the terms of the UK’s exit from the bloc is still unknown. The exit date from the EU is set for 29th March 2019, and people are becoming more and more uncertain about what changes will be made to the ‘right to work’ legislation.

On 19th March 2018, the UK government agreed that any EU migrants who arrive in Britain in the transition period would be allowed to settle in the UK, with the same rights as pre-Brexit EU migrants. This transition period will continue until 31st December 2020.
Under the EU Settlement Scheme, EU citizens will be able to enforce their rights until this date. Additionally, eligible individuals who have lived in the UK for at least five years prior to the end date will be granted ILR (Indefinite Leave to Remain). Also, those who have been in the UK for a shorter period will be granted five years LTR (limited leave to remain). Once the five-year point has been reached, they too will be able to apply for ILR. The scheme is currently being trialled in parts of the UK, at a number of universities and NHS foundation trusts. The application fee is £65 (reduced to £32.50 for under 16s.)
What if there’s no Brexit deal?
The government has issued a guide for what to do if no Brexit deal is made. It confirms that little will change in workplace rights. Additionally, a guide has been issued for those who work for a UK employer outside the UK.
