The Skilled Worker visa is based around a sponsorship system: a foreign worker cannot apply for this visa without a sponsor. Applicants require a job offer before they can apply.
The first stage in the process is for the employer to secure a Skilled Worker sponsor licence which enables them to issue sponsorship certificates (essentially, virtual work permits) to applicants so they can obtain a visa. EU nationals arriving in the UK after 1st January 2021 now need a visa to work in the UK, so more employers will need a Skilled Worker sponsor licence.

The proposed sponsor has to submit evidence that it is a genuine employer lawfully trading in the UK.

The Home Office require the organisation to be “honest, dependable, reliable”, and capable of meeting its responsibilities under immigration law.
- The sponsor must have human resource and recruitment systems so it can meet its sponsor duties
- The Home Office must be able to visit and conduct checks on the sponsor duties immediately and unannounced; which includes checks at the physical addresses where the sponsored employees work
- The sponsor must be able to offer a genuine vacancy in the category the sponsor applies for a license for
- Key personnel within the business must not have an unspent criminal conviction for relevant offences
