This new, tailor-made immigration route was introduced by the British government after the Chinese government announced a new National Security Law for Hong Kong. The new BN(O) Visa represents a significant change to the UK immigration system – allowing Hong Kong citizens to apply for either two 30-month periods or 5 years’ leave. The new immigration route gives BN(O) citizens the right to live, work and/or study in the UK, and represents a path to full citizenship.

Those who take advantage of this new immigration route will have full access to the UK labour market without salary thresholds, but cannot claim public funds.  The Hong Kong BN(O) Visa is similar to other visas in that Indefinite Leave to Remain (ILR) can be granted after five years of continuous residence and, once ILR has been held for 12 months, holders can apply for full British citizenship.

The new immigration route is not contingent on holding a Hong Kong BN(O) passport. Applicants will require a passport for proof of identity, but this can be of any nationality. The new route is set to open in January 2021. The government in the UK has said that those who wish to travel before the route opens can do so, subject to standard immigration checks.  BN(O) citizens can enter the UK as a visitor for six months without a visa.
