The couple, who are aged 83 and 73, are part of a close-knit family. They have lived in a flat in Edinburgh since 1978 and act as co-parents for a grandson with severe autism who requires supervision round the clock. Their support is relied on by the child’s mother – a single parent who works as a nurse in the NHS.
The couple say that to return to Iran is not physically possible because of their illnesses, which they say could not be managed by the Iranian health care system – and regardless, they have no connection to Iran as their entire family network lives in the UK.
The couple has made multiple human rights applications to remain in the UK since 2013 to no avail. The final appeal over the decision is due to be heard shortly. Before their first application, their acute needs would have been sufficient to be granted visas. Profound changes to the immigration rules made by Theresa May to reduce net migration to the UK included the tightening of the “adult dependent relative” rule. This is why their circumstances are no longer allowed to be taken into account. The changes made it almost impossible for a British Citizen to bring their foreign adult parents to the UK to care for them.
The Home Office commented on the case, saying that “All visa applications are considered on their individual merit, on the basis of the available evidence and in line with the immigration rules.”
