High Court Legal Challenge Stops Immigration Deportations

After the charity Medical Justice took the Home Office to court over its policy, a total of 69 deportations have been cancelled. Many more will now not go ahead. Medical Justice campaigns for access to healthcare by migrant detainees. It said that most detainees had not got sufficient time to get legal representation.

What is the Issue?

Although the Removal Notice Window gave migrants from three to seven days’ notice of removal from the country within three months, the Home Office could still remove people even after the three months has passed so the process could continue indefinitely. The Home Office said this is to ensure migrants make their intention to stay in the country known before the time has passed, but Medical Justice charity obtained a full judicial review at the High Court. Until then, the policy has been halted.

Who has been affected?

One example is a man from the Windrush generation who was served with an RNW after coming to Britain in 1998 to visit his girlfriend. After marrying a year later, he was granted indefinite leave to remain. Despite living in the UK since he was issued an RNW in 2017. He could not access immigration lawyers, but luckily his wife could. After evidence was provided of his 30-year stay in the UK, his deportation was cancelled.

What happens next?

The ruling does not stop the deportations entirely. For now, the Home Office must provide a specific date of removal will take place. A full hearing will take place in the summer.
