The government gave assurances that they would not infringe the rights of EU citizens if they had applied for the EUSS scheme. A legal support charity, Bail for Immigration Detainees has written to the Home Office to outline their concerns about the reports.

Their Legal Director Pierre Makhlouf wrote: “We have noticed delays in acknowledging paper applications under the EU Settlement Scheme. Where applications were made, the Home Office adopted the position that there is no evidence of applicant making an EUSS application, saying in the circumstances the individual may be removed.”

The Guardian reported that BID is submitting an official complaint to the European Commission if it does not get a “meaningful response” to its letter. Legal experts warn that the situation could indicate how the rights of EU citizens are to be protected post-Brexit. The Guardian article said there was no apology or explanation issued as to why they issued proceedings against an individual who was later released when a judge found a valid EUSS application had been made.

There were a number of assurances from government ministers that EUSS applicants would be able to submit applications after the June 30th deadline, so long as there were “reasonable” grounds. In another example, an applicant who submitted an online application in mid-July found it was not acknowledged by the Home Office and they stated there were “no barriers to his removal”.
