A CoS is a record that is assigned to every one of an employer’s foreign workers. The electronic record is issued to an employer that has a Sponsor Licence. Only after the document has been issued may the employee make a Tier 2 Visa application.

Types of Certificate of Sponsorship

There are two types of CoS: a restricted one and an unrestricted one. The number of restricted CoS is limited to 20,700 per year. An unrestricted CoS may be reissued again and again. An employer needs a restricted Certificate of Sponsorship to employ someone from outside the UK unless the role has a salary of greater than £159,600 or the job promotes inward investment. The same rules apply to an unrestricted CoS except they are mainly used to employ people already residing in the UK who want to apply for a Tier 2 Visa. They expire every year, so a renewal must be made as soon as practicable.

A Cos needs to be renewed if you hire staff based abroad to work in the UK on a temporary basis; if you wish to hire a UK-based migrant who is new to the business; or if you already have migrant staff that need to extend their stay. It is vital that employers carry out this check before the deadline as the Visa and Immigration Department will not guarantee renewal beyond this date.
