Getting married cannot stop deportation or removal once it is ordered by the Home Office. There is a process to be followed for people who want to marry in the UK, and an immigration check is undertaken on both partners. It is unlikely that an undocumented immigrant in the UK could get married. However, it is even more unlikely after a deportation order has been issued. In some instances, a deportation order can be appealed. In such cases, an individual could be granted leave to remain, and should they fulfil certain eligibility criteria, be allowed to marry.

Deportation means an individual must leave the UK. Until they do so, they may be held in a detention centre while arrangements are made. There are a number of grounds meaning an individual may be deported. For example, if some of the following applies to a case:

  • If a court judges that for this person to be deported would be conducive to the public good
  • If the person has been convicted of an offence and sentenced to a imprisonment for 12 months or more
