Article 50: Can The UK Cancel Brexit?

Article 50 is the part of an agreement between the European Union (EU) members, called the Lisbon Treaty, which explains what happens if a country decides that it wishes to leave. This was triggered by Theresa May on 29th March 2017, which set into motion a two-year countdown – although this time has now been extended.

How could it be revoked?

According to a ruling by the European Court of Justice (ECJ) last year, the UK could revoke Article 50 unilaterally (by itself), without asking permission from the other 27 EU nations. This could be done by writing a letter to the European Council, which is made up of the EU members’ heads of state.

The ECJ said that if it did this, the UK would remain a full member of the EU on the terms it has now – including the discount that is applied to the UK’s payments to the EU.

There are some conditions: revocation must be “unequivocal and unconditional”, so the UK could not revoke Article 50 just to buy more time and then later resubmit its intention to leave later. Senior lawyers at the ECJ say that legal action could be used if the UK or another member attempted to trigger and then revoke Article 50 to try to get a better deal.
