Theresa May, the Prime Minister, hoped to get the Withdrawal Agreement she negotiated with the EU passed by Parliament. However, it has now been rejected a total of three times. In order to mitigate the consequences of a no deal Brexit, the EU has completed preparations and ordered its member states to do the same. The Government has stated that EU nationals can still come to the UK and stay here if they wish, but they must apply for permission under a scheme called “European Temporary Leave to Remain.”

What is European Temporary Leave to Remain?

European Temporary Leave to remain is the initiative from the Government for citizens of EU, EEA and Swiss member states to come to the UK after April 12. It will only come into effect if the UK leaves the EU without a deal. It will give EU citizens the same rights they currently have under free movement rules: they can live, work and study in the UK – but only for a maximum period of three years and it cannot be extended. After that EU citizens will have to apply to remain in the UK under a new immigration system which is due to come into effect on 1st January 2021.

European Temporary Leave to Remain: Who will be eligible?

All EU, EEA and Swiss citizens who come to the UK after April 12th will be eligible – except Irish citizens who do not need to apply because of the Common Travel Area (CTA) rules which permits free movement in the UK, Republic of Ireland, Jersey, Guernsey and the Isle of Man.
