How is the scheme operating and what do the delays indicate?

What do the figures show?

Statistics from a freedom of information request show that 33,350 applications waited for a decision for three to six months by October 2019. These figures are only a snapshot of the caseload on the day it was captured and does not indicate the total number of delayed cases. This data does still provide some indication of how many applications face significant delays.

Why are some decisions taking so long?

The Home Office initially stated that applications would take between 1 and 4 calendar days. That was extended to “around 5 working days… but can be up to a month” in January 20202.

  • Applications are likely to take longer than a month to process if:
  • The Home Office needs more information from the applicant
  • The applicant is a minor with an application is not linked to an adult
  • The application includes a paper application
  • The applicant has a criminal record
  • The applicant is not an EEA or Swiss citizen and is applying based on a relationship they have not relied on in any previous applications

There are now likely to be even more delays in the future thanks to the impact of the COVID-19 lockdown; for example the closing of the Settlement Scheme call centre for several weeks and the reduced capacity for voluntary organisations that provide support to applicants.
