From 2021, UK businesses who wish to employ workers from the EU must get Home Office approval. With just weeks to go until the freedom of movement ends, thousands of businesses may not be ready to sponsor foreign employees. The Home Office has launched a campaign to remind businesses to apply for a Sponsor Licence. The campaign is running via a wide range of channels including radio, outdoor advertising and social media, aiming to target employers who are not yet sponsored.

In an attempt to help with the new system, the Home Office has introduced lower skills and salary thresholds. A spokesman said: “We are introducing special schemes to enable more scientists, investors, academics, health and care workers and entrepreneurs to come to the UK and we are reviewing the independent Migration Advisory Committee’ recommendations on the shortage occupation list so the government can help sectors fill roles quickly.”

How to apply for a UK Sponsor Licence

It takes 6 to 8 weeks to process an application for a sponsor licence. This means UK businesses must apply now, or risk being caught out when the UK leaves the EU.

Employers who already hold a sponsor licence

The new immigration system does not apply to EU citizens who began their UK residence before 31st December 2020 and submitted an application under the EU Settlement Scheme prior to 30th June 2021. Employers in the UK should make sure their EU workers apply to the Scheme if they meet the eligibility requirements.

Tier 2 sponsors will automatically be granted a new licence to employ skilled workers from the EU.

If your sponsor licence has expired

Your sponsor licence expires on the date shown on the summary page of the Sponsor Management System (SMS). If you need to renew, you can submit a request up to three months before it expires. You can apply in the SMS system, and the Home Office begin to evaluate your case as soon as you pay the appropriate fee.
