The 31-year-old lawyer had submitted a Spouse Visa application to bring his newly-married wife, a dyslexia specialist, to join him in the UK. He was acting as a sponsor for the application as he is a British citizen, and he submitted hundreds of pages of supporting paperwork to the Home Office. A Spouse Visa application requires the applicant to submit paperwork pertaining to income and employment along with evidence of the relationship being ‘genuine and subsisting’. To complete and submit the application to the Home Office cost of £3,204 plus legal costs, but he received a letter of rejection for the £95 Visitor Visa application, not the one he submitted.
The Home Office has apologised for sending a ‘blank visa refusal notice’ and said that the Visitor Visa refusal has been overturned so the Spouse Visa application can be reconsidered. The same family has been affected by Visa issues in the past. When the lawyer’s brother applied for a Spouse Visa for his wife, the Home Office refused it as they said it was not credible for him to be away from the family business for several months. An immigration tribunal rejected the refusal and ordered the Home Office to pay £140, which the couple are yet to receive.
Regarding this case, a Home Office spokesperson said: ‘The application was correctly handled by the Home Office as a spousal visa and refused. However, due to an admin error, an incorrect form was issued. In light of this, we will review the application. We apologise for any inconvenience and will contact the customer directly.’
